Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the operator of Bazaar Flipper Mod ("we," "us," or "our"), governing your access to and use of the Bazaar Flipper Mod software, website (bazaar-flip-mod.com), and all related services (collectively, the "Service").

We may update these Terms at any time. This includes changes to pricing, plans, feature access, supported versions, authentication rules, hardware limits, integrations, and acceptable use rules. Unless a later date is stated, updated Terms take effect when posted. If you continue using the Service after the effective date, you accept the revised Terms.

Bazaar Flipper Mod ("BFM") is a Minecraft client-side modification designed exclusively for use on the Hypixel SkyBlock server. The Service provides:

• Real-time bazaar price tracking and analytics
• Automated flip calculations and profit optimization
• Market trend analysis and historical data
• Account management dashboard and Discord bot integration
• Cloud-based license authentication system

The current install and activation flow is Windows-only and requires a valid BFM account, an active license, and a linked Discord account. Unsupported setups, launchers, or operating systems may fail to authenticate or run correctly.

4.1 Account Creation

To use the Service, you must:

• Create an account with a valid email address, Minecraft UUID, and linked Discord account
• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Own a legitimate Minecraft Java Edition account

4.2 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized access or security breach

We will not be liable for any losses arising from unauthorized account use if you fail to protect your credentials.

4.3 Age Requirements

By using the Service, you represent that you have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction (typically 18), you must have parental or guardian consent to use the Service and make purchases.

5.1 License Grant

Upon purchase and subject to your ongoing compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Bazaar Flipper Mod on a single device at a time.

5.2 License Types

• Lifetime License: Single concurrent device, all features, one-time purchase - valid for the lifetime of the Service
• Monthly License: Single concurrent device, all features - manually renewed each billing period (no automatic recurring charges)
• 3-Month License: Single concurrent device, all features - manually renewed every three months

5.4 Device Limitation

Your license permits use on one (1) device only. HWID changes are reviewed by support and approved only at our discretion. Concurrent use on multiple devices is prohibited and may result in license suspension or termination.

• Share, sell, rent, lease, sublicense, or transfer your license to any third party
• Use the Service on a different hardware ID (HWID) without an authorized HWID reset
• Modify, decompile, reverse engineer, disassemble, or create derivative works
• Circumvent any authentication, security measures, or license verification systems
• Remove, alter, or obscure any proprietary notices or branding
• Use the Service with cracked or unauthorized Minecraft accounts
• Distribute, leak, or publicly share the software files or authenticated account access
• Use automated tools or scripts to interact with our authentication systems
• Attempt to discover other users' identities or accounts

8.1 Hypixel Rules & Risk Acknowledgment

BFM automates bazaar interactions and functions as a macro. It is not compliant with Hypixel's Terms of Service, which prohibit automated gameplay. By using BFM, you acknowledge and accept:

• BFM is a macro that automates in-game actions, which Hypixel does not permit
• You use BFM entirely at your own risk
• You are solely responsible for any consequences on your Minecraft or Hypixel account

8.2 Policy Changes

If Hypixel updates their detection methods or policies, we will make reasonable efforts to adapt the software. However, we cannot guarantee continued undetectability.

9.1 Authentication Requirements

The Service requires periodic online authentication to verify license validity. By using BFM, you consent to:

• Automatic license verification checks when launching the mod
• Hardware fingerprinting (HWID) for device identification
• Discord account linking as part of the activation flow
• Collection of Minecraft UUID and authentication tokens
• Transmission of usage data for anti-piracy purposes

9.2 Anti-Piracy Measures

We employ various technical measures to prevent unauthorized use, including encryption, obfuscation, and remote license validation. Attempting to circumvent these measures violates these Terms and may violate applicable laws, including the EU Directive 2001/29/EC.

All source code, algorithms, methods, techniques, processes, designs, graphics, user interfaces, software architecture, and other materials comprising Bazaar Flipper Mod are the exclusive property of the operator and are protected by:

• EU copyright laws and international treaties
• Trade secret protections
• Proprietary rights and ownership

11.1 Information We Collect

By using the Service, you consent to our collection of:

• Account information (email, Minecraft UUID, username)
• Hardware identifier (HWID) for license verification
• IP addresses and approximate geolocation
• Discord account information (if you use Discord integration)
• Usage statistics and feature analytics
• Payment information (processed securely via Stripe)

11.2 How We Use Your Data

• License Management: Authentication and verification
• Security: Anti-piracy and fraud prevention
• Service Improvement: Analytics and bug tracking
• Customer Support: Responding to inquiries and issues
• Legal Compliance: Meeting legal obligations

11.3 Data Protection

12.1 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's terms of service and privacy policy.

12.2 Pricing

• All prices are currently listed in USD and may be subject to VAT/sales tax where applicable
• Prices, plans, packaging, feature access, and eligibility rules may change at any time
• License renewals are manual - you will not be charged automatically when your license expires

Unless required for fraud prevention, security, compliance, or correction of an obvious error, pricing changes apply prospectively and do not shorten an already-active paid term.

12.3 Chargebacks and Disputes

If you have a billing dispute, please contact us via Discord or email before initiating a chargeback. We are committed to resolving legitimate disputes fairly and quickly.

Due to the digital nature of the Service, refunds are generally not provided once access has been delivered or activated. We may still issue refunds when required by law or when we choose to make a case-by-case exception.

13.1 EU/EEA Consumers

Under EU Directive 2011/83/EU, you have a 14-day right of withdrawal. However, by accessing the digital content (logging into BFM), you explicitly waive this right. This consent is obtained via mandatory checkbox during purchase.

13.2 Refund Eligibility

• ✓ Critical technical issues we cannot resolve
• ✓ Service unavailable for 24+ hours
• ✓ Duplicate charges or billing errors
• ✗ Changed mind after accessing the Service
• ✗ Account bans due to Terms violations
• ✗ Hypixel game updates or policy changes

14.1 Termination by Us

We may terminate or suspend your license immediately, without prior notice, if you:

• Violate any provision of these Terms
• Engage in prohibited activities (Section 7)
• Use the Service fraudulently or unlawfully
• Initiate a chargeback without prior contact
• Attempt to reverse engineer or distribute the software

14.2 Appeals

If your license is terminated, you may appeal by:

• Opening a ticket in our Discord server
• Emailing [email protected] with detailed explanation

Appeals are reviewed at our sole discretion. Creating new accounts to evade a ban is prohibited and may result in legal action.

14.3 Service Discontinuation

We may discontinue the Service, or any feature, integration, plan, supported version, authentication method, or workflow, at any time. We will provide advance notice when reasonably practical, but we are not required to keep any specific feature or version available forever. No refunds will be provided for discontinued "lifetime" licenses except where required by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• That the Service will be error-free, uninterrupted, or bug-free
• That the Service will remain compatible with all Minecraft versions
• That the Service will remain undetected by anti-cheat systems
• That the Service will remain undetected by Hypixel's anti-cheat systems

Use at Your Own Risk: You assume all risks associated with using BFM, including potential account penalties from Hypixel, loss of in-game items or progress, or other consequences. We are not responsible for any such losses.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid for your license in the 12 months prior to the claim.

We shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Loss of game progress, items, or Minecraft accounts
• Actions taken by Hypixel, Mojang, Microsoft, or other third parties
• Incompatibility with other mods or software
• Service interruptions or downtime

EU Consumer Rights: Nothing in these Terms limits your statutory rights as a consumer under EU law, including rights related to defective digital content under Directive 2011/83/EU.

16.1 Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the Service
• Your violation of any third-party rights
• Any content you submit through the Service

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Romania and the European Union, without regard to conflict of law principles.

17.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Romania, within the European Union. EU consumers may bring proceedings in their country of residence as permitted by EU Regulation 1215/2012.

17.3 Informal Resolution

Before initiating formal legal proceedings, you agree to attempt informal resolution by contacting us via Discord or email for at least thirty (30) days. Most disputes can be resolved quickly and amicably through direct communication.

17.4 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17.5 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements, understandings, or communications.
